Can Marvel still use characters created through their licensed properties?
I’ve been going through my old collection, reading titles like Team America, US1, Transformers and Godzilla. These were all Marvel licensed titles, but some characters were created specifically for the comic, and in the fine copywrite print, those characters ownership were credited to Marvel, not to the manufacturer or production company. Does this mean Marvel can still use those characters as long as they don’t mention their licensed origination?
I can’t tell the answer to your question from the information you provided. The most likely situation, judging from what you’ve said, is that the characters specifically created for the comic were created as wroks for hire for Marvel, meaning Marvel owned the copyright from the start. If that is true, or if Marvel outright purchased the copyright after creation, then Marvel owns the characters and can do what they like with them (and can mention the way they originated or not.)
If the copyrights have been sold, there may or may not be restrictions in the contracts under which the copyrights were sold.
And of course, whether or not Marvel at one point owned the copyrights outright, they may have sold or licensed them since, and so would be bound by those newer agreements.
(The question of what exactly is copyrighted when a “character” is copyrighted can get complicated, though where the character is embodied in a drawn image, there usually is sufficient copyright protection.)
