Trying to Garnish Wages on a closed account?

I got a call today from palisades collection agency saying that they were going to have a take me to court for $999. I made a BIG mistake in the past and opened a credit card account in 2001. I haven’t used the card since probably 2002, and it is closed on my credit statement and doesn’t say I owe anything. Should I believe them when they say they are going to garnish my wages? Should I just plead guilty or should I send a letter to the judge stating that this is an old debt, the statue of limitations is 6 years in Oregon. Are they just trying to get money out of me?

Did you leave an unpaid balance on the account?

If the account has gone to collections, the original creditor would show up on your credit report as charged off and 0 balance. This does not mean you don’t still owe the money.

The Statute of Limitations (SOL), the timeframe to bring lawsuit, typically starts from the date of last activity or last payment. If that date is December of 2002, the debt is still within the 6 years. They could still file a lawsuit. They can’t garnish you wages until the win a lawsuit.

Send the collection agency a certified, return receipt letter asking for validation of the debt to include copies of the contract or other documentation that proves you owe this debt. Also, ask for proof that the debt is still within the SOL.

Chances are they are just trying to scare you into sending them money. Don’t talk to them on the phone. Get every thing in writing. If you do receive a summons for court, be sure to respond to the summons and show up in court. If you no show, they get a default judgment.
